What you can do without a license
OREC's rules make the broker responsible for all real estate related activities of any unlicensed assistant working in the firm. An associate who employs an unlicensed assistant shares that responsibility with the broker.
You can do (no license needed)
- Maintain the broker's or licensee's office and do general administrative work.
- Act as a courier.
- Submit listing information to the MLS or a third-party listing service.
- Prepare listing packets as directed by the licensee.
- Prepare purchase packets, contracts and forms as directed, with the licensee approving the content.
- Review documents for completeness, and organize or assemble documents for closing.
- Communicate with title companies, inspectors and appraisers, and coordinate closings.
- Schedule showings and other appointments.
Needs a license
- Prepare agreements without approval from the licensee.
- Present or explain agreements.
- Negotiate with any party, or negotiate offers to buy or sell.
- Give advice to the parties.
- Show property, interview purchasers, or help purchasers search for and acquire property.
- Prepare or present cost or market information, including a comparative market analysis.
- Solicit listings or purchasers in any conversation or personal contact.
- Collect a fee or be paid on the basis of commission, or any amount based on listings or sales.
A practical example
- You can:
- Your agent gives you the price, earnest money and closing date. You fill them into the contract and your agent approves it before it goes out.
- Refer to the agent:
- The buyer asks what a contract clause means, or wants to change the offer. Send it to your agent.
Staying on the right side of the rules
Broker responsibility
Under OREC's rules, "A broker is responsible for all real estate related activities of any unlicensed assistant working within the firm" (OAC 605:10-9-1(g)). An associate who employs an unlicensed assistant is responsible together with the broker (OAC 605:10-11-1(c)).
Penalties for unlicensed activity
It is unlawful to act as a real estate licensee without a license (59 O.S. § 858-301). An unlicensed person who violates the License Code can be convicted of a misdemeanor, with a fine of up to $5,000, up to six months in county jail, or both. OREC can also fine an unlicensed person up to $5,000 or the commission earned, whichever is greater, for each violation (59 O.S. § 858-401).
General guidance
OREC says its list "does not encompass every activity that an unlicensed assistant may or may not perform" and is "general guidance." For anything not on it, ask your broker or the Commission.

Thinking about a license?
You don't need one to work as a TC in Oklahoma. A license lets you also do the work in the "Needs a license" column, under a broker. Here's what's involved:
Oklahoma's first license is a provisional sales associate license. You complete a 90-hour pre-license course and a background check through IdentoGO, then apply online; after OREC approves the application, Pearson VUE contacts you to schedule the exam. A sales associate works for a broker, and a provisional license comes with a 45-clock-hour post-license course to finish within the first 12-month license term. How to apply.
